Protecting the Rights of Beneficiaries
In representing beneficiaries, we assist in dispute resolution, asset protection and taxation issues. The amount you are taxed depends on which class of beneficiary you belong to.
In New Jersey, beneficiaries fall into one of three categories:
- Class A beneficiaries: Spouses, parents, domestic partners, grand parents and decedents fall into this category. Class A beneficiaries are completely exempt from New Jersey inheritance tax.
- Class C beneficiaries: Siblings and spouses of children make up this category. Class C beneficiaries can receive up to $25,000 without being taxed. Anything over that amount is taxed at 11% - 16%.
- Class D beneficiaries: All other beneficiaries fall into this category. Class D beneficiaries can receive up to $500 with no tax burden. Anything above that amount is taxed at 15% - 16%.
- Class E beneficiaries (Charity): Any inheritance left to a charitable organization is totally exempt from New Jersey inheritance tax.
Class B beneficiaries is no longer a category. Life insurance paid to a named beneficiary is also totally exempt from state taxes to the beneficiary.
