Man pulled over for speeding is arrested on drug charges

A New Jersey man is facing serious drug charges after being pulled over for a traffic violation. Police report that they observed the man speeding in the area of West Front and Richardson on Aug. 28. They pulled him over and noted the smell of burnt marijuana coming from his car. They then searched his vehicle and allegedly found a partially smoked cigar filled with marijuana, another bag of marijuana, cocaine assorted paraphernalia and a substantial amount of cash.

The man was taken into custody and transported to the Burlington County Jail. He is being charged with possession and distribution of drugs. He is being held in lieu of $50,000 bail. There is no information on whether the defendant had any drugs in his bloodstream at the time of the arrest.

When an individual is pulled over for a traffic violation, the police may be able to search the car if they have reasonable cause to believe that the driver or passengers are guilty of other crimes. At first glance, it may seem that the smell of burnt marijuana is enough to establish cause, but this may not be the case. Any drug charge can carry heavy penalties that may follow a defendant for years to come. This is why it is important for individuals to proactively defend their rights.

Attorneys for the defense may choose to look deeper into the search and subsequent arrest to ensure that the defendant's rights were not violated at any time. They may be able to conduct investigations into the arresting officers to see if there are any troubling patterns of behavior with regards to traffic stops or searches. In the event that the initial traffic stop, search and arrest were justifiable, attorneys may still be able to work within the legal system to minimize the resulting consequences and overall impact on a defendant's life.
