New Jersey man facing weapon, drug charges

According to police, a man was taken into custody and has been charged with several offenses, including drug and weapon charges. Agents with Border Protection and New York Customs reportedly intercepted an international package that contained a significant amount of a psychedelic and stimulant drug called ethylone on Aug. 25. The following day, Aug. 26, members of different law enforcement groups conducted a controlled delivery of the package to the defendant.

According to the complaint, the defendant allegedly accepted the delivery and was subsequently taken into custody. The defendant then consented to a search of the residence. In the home, officers reportedly found a number of hollow point bullets, a .45-caliber handgun, marijuana and around 60 grams of suspected Ecstasy. He is facing charges of distribution of synthetic marijuana, possession of controlled dangerous substances, possession with intent to distribute and possession of a firearm while committing a drug offense.

In the above story, the defendant reportedly agreed to allow law enforcement officials to search his residence. In some cases, an individual may not be required to let officers search his or her property unless the officers have a search warrant.

A New Jersey criminal defense attorney may look at a situation in which a defendant's home was searched without a warrant to determine whether the defendant was coerced into allowing the search. If the defendant's rights were violated, the case might be dismissed or dropped. Alternatively, the attorney may suggest a plea bargain, which would allow the defendant to avoid a trial and seek lower penalties. In most situations, the defense attorney and prosecutor negotiate the terms. However, the defendant has the right to refuse a plea deal and go to trial instead.
