Unlicensed driver charged in fatal Trenton crash

For those of us who abide by the rules of the road, it's hard not to feel anger and frustration toward unlicensed, drunk, and distracted drivers who get behind the wheel and put us all at risk. When injuries are sustained – or worse, fatalities – senseless car accidents caused by careless or reckless drivers become truly devastating for all involved.

This was what happened on Father's Day in Trenton when a father was killed in a tragic car accident in which his two children also suffered serious injuries. One child was subsequently declared brain dead and the other has non-life threatening injuries including a broken bone. According to police reports, the fatal accident was allegedly caused by a drunk driver who was operating his vehicle without a driver’s license. 

The other driver has been charged with DWI and several serious criminal counts related to the fatalities and injuries. Now that a young child has been declared brain dead, additional charges could be forthcoming. In addition, the surviving family members of the father and children may decide to file a personal injury lawsuit against the driver.

One often-overlooked consequence of these tragic events is that the surviving family members have lost not only a father but a source of income. While we can only speculate at this point, it may be the case that the other driver does not have auto insurance or substantial assets with which to pay damages or cover the family’s medical expenses. Whether the accident victim's insurance pays, and how much, depends in large part on the type of insurance the driver carried along with a determination of liability.
