Drugs have become a serious problem in New Jersey and throughout the country. As a result, many police departments are conducting focused investigations and property searches in an effort to combat this problem. In the event that drugs are discovered, drug charges are typically filed against the individuals suspected of possessing them. New Jersey residents who find themselves facing a drug charge need to know that they have legal rights to which they are entitled.
Recently, a man was driving his pickup truck in Montville. According to reports, he had been a target of a police investigation; therefore, state troopers decided to stop him. After being granted permission to search his truck, police found marijuana in the truck. The man was arrested and charged with drug possession.
In preparing to defend these types of charges, there are many things that typically need to be considered. One of the first items is whether the state troopers had the right to stop him in the first place, and the circumstances under which the permission to search was granted. Yet another consideration is whether or not the driver even knew the drugs were in his truck.
An individual who is accused of a drug charge in New Jersey can face serious consequences if convicted. Fortunately, the individual is also entitled to present a defense and obtain a fair trial. Proper analysis of investigative procedures and the evidence presented against the individual will give the individual planning a defense against criminal charges a good idea of the appropriate strategy for approaching these types of accusations.
