New Jersey man faces traffic violations, drug charges

Police say they took a driver into custody for drug possession and cited him for traffic violations after they pulled over his vehicle in Clinton Township. The traffic stop occurred around 11 p.m. on July 30 because a taillight on the vehicle was out.

Police say the 19-year-old driver pulled into a resident's driveway and tried to exit the vehicle. An officer allegedly determined that the man was driving on a suspended license and found a glass container with marijuana inside, the remains of a marijuana joint and a residue-enlaced glass pipe.

The driver was subsequently taken into custody and later released. He is charged with possession of drug paraphernalia, possession of less than 50 grams of marijuana and driving a vehicle while in possession of a controlled dangerous substance. He also faces charges of driving with a suspended license, failing to produce vehicle registration and failing to maintain his vehicle lights.

When a person is convicted of a marijuana drug charge in New Jersey, he or she may be sentenced to imprisonment, have to pay a fine or both. People who are convicted a second time could receive double the sentence. However, there are a few strategies that lawyers might use to prevent such convictions.

One strategy is finding evidence that police did not conduct a legal search and seizure or that police violated the rights of the accused. Another strategy is determining whether the drugs exist; sometimes drugs go missing while they are being processed. Using either of these strategies might result in the drugs being ruled inadmissible, which means that the charges would be dropped.
