Owner of New Jersey tattoo business faces drug charges

Officials have charged the 41-year-old owner of a tattoo business in Wildwood in connection with possession and distribution of synthetic marijuana. The charges followed the execution of a search warrant at the man's business. After being charged, he was released with a summons complaint.

Officials indicated that this incident was part of an area initiative by the law enforcement community to pinpoint businesses selling various controlled substances including illegal designer drugs. The joint efforts of several agencies are reportedly aimed at protecting area children and the community at large from dangerous substances.

The individual charged in this case refused comment, noting a desire to discuss the situation with an attorney prior to making any public statements. In this case, a third-degree charge may result in a sentence of three to five years if a conviction is achieved. The second-degree drug trafficking charges could result in five to 10 years of prison time.

An individual involved in a similar situation might find that reserving comment provides for a better opportunity to keep various defense strategy options available. Because a statement might be used in court, any public comment without legal counsel could negatively impact a defendant's case. Although evidence may be collected as a search warrant is executed, a defense attorney might begin by exploring the steps taken in securing and carrying out such a warrant. Errors in protocol could result in such evidence being inadmissible due to violation of a defendant's search and seizure rights.

An attorney helping a client who is facing drug possession and trafficking charges may evaluate evidence and other factors to determine whether a case is likely to be proven. In some cases, seeking a plea deal may be preferable to going to trial.
